1. About these terms

These terms apply to purchases from TouchUpPaintX at touchuppaintx.com, operated by EVE PAUL LLC. References to “we,” “us” and “our” mean EVE PAUL LLC, trading as TouchUpPaintX. You must have legal capacity to place an order or have authorization from a person who does.

2. Product selection and use

Our touch-up paint products are intended for localized paint chips and scratches. The buyer is responsible for checking the complete OEM paint code, application and product description before ordering. A vehicle make, model, year, color name or screen image alone may not identify the correct paint.

Follow the product label and supplied application and safety instructions. Test on a separate surface before use. Touch-up paint is not a guarantee that damage will disappear or that a repaired area will be indistinguishable from the surrounding finish. Nothing in these terms excludes responsibility for a defective or incorrectly supplied product or any right required by law.

3. Orders, prices and payment

Prices are shown in U.S. dollars. Applicable taxes and the final order total are displayed at checkout. We may correct an obvious listing, pricing or stock error before accepting or fulfilling an affected order. If we cannot fulfill an order, we will notify you and refund payment for the unfulfilled items. We will not charge a higher corrected price without your agreement.

An order acknowledgement confirms that we received your order; it does not guarantee fulfillment. We may decline orders that cannot be fulfilled or that reasonably appear fraudulent. Any captured payment for an order we decline will be refunded promptly.

4. United States shipping

We currently accept delivery orders to the United States only. Standard U.S. shipping is free. Orders normally ship within two business days via USPS Ground Advantage. Carrier transit time is additional, and business days exclude weekends and public holidays.

If we cannot ship within the promised time, we will notify you, provide a revised estimate, and offer the opportunity to agree to the delay or cancel the unshipped portion for a refund, as required by applicable law. We do not guarantee a carrier delivery date unless expressly stated at checkout.

Provide an accurate, deliverable shipping address. Contact us promptly about address errors or missing deliveries so we can investigate. This paragraph does not transfer responsibility for our shipping mistakes to the buyer.

5. Returns and refunds

Our published Refund and return policy forms part of these terms. We do not offer voluntary change-of-mind returns. Defective, damaged and incorrect items will be handled under that policy and applicable law.

6. Website content and availability

Product information and website content may be updated. We aim to keep information accurate but may correct errors. A change to these terms does not retroactively change an order already accepted. The terms in effect when your order is accepted apply to that order.

Our original branding, photographs, text and design are protected by applicable intellectual-property laws. Vehicle brand names and paint codes are used to describe product compatibility; they do not imply that the vehicle manufacturer endorses TouchUpPaintX.

7. Liability and mandatory rights

To the extent permitted by applicable law, we are not liable for indirect or consequential losses arising from use of the website or products, and our liability for an affected product is limited to the amount paid for it. These limitations do not apply where prohibited by law and do not exclude liability for fraud, willful misconduct, personal injury caused by negligence, or other liability that cannot lawfully be excluded. Any applicable non-waivable warranty or consumer remedy remains in force.
